4.2 For Employers

Our Services enable employers to:

• Post job listings and manage openings
• Search and browse candidate profiles
• Use AI-powered candidate matching and screening
• Conduct skill assessments and view scorecards
• Communicate with candidates
• Manage the recruitment pipeline

4.3 Partner Program

Partners may participate in our referral program subject to separate Partner Terms and Conditions.

5. User Content

You retain ownership of content you submit ("User Content"), including profiles, resumes, job postings, and messages. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and improving our Services.

You represent and warrant that your User Content:

• Is accurate and not misleading
• Does not violate any third-party rights
• Complies with all applicable laws and regulations
• Does not contain malicious code or harmful content

6. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Post false, misleading, or fraudulent information
• Harass, threaten, or discriminate against other users
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or collect data without permission
• Interfere with the proper functioning of the Services
• Post spam, advertisements, or promotional materials without authorization
• Impersonate another person or entity
• Use the Services for any illegal or unauthorized purpose

7. Intellectual Property

The Services, including all content, features, and functionality (excluding User Content), are owned by Hiry AI and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

8. Third-Party Services

We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information
• Warranties that job seekers will find employment or employers will find candidates

We do not guarantee employment outcomes or the accuracy of AI-generated recommendations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Hiry AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Hiry AI and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
